About Cipta Partners

A deliberate IP practice built on clear records, candid advice, and respect for the rights-holder's own judgment.

How We Came to Be

Cipta Partners began from a straightforward observation: too many Malaysian businesses arrive at enforcement or diligence with incomplete records of what they actually own. Trade marks filed without proper specifications. Copyright chains that stop one assignment short. Design registrations that lapsed before anyone noticed.

The practice was founded in Petaling Jaya to address that gap — working upstream, at the point where ownership is established and documented, rather than downstream when a dispute has already taken shape. The name "Cipta" carries the sense of creation and authorship in Malay, which is the ground on which all intellectual property stands.

Our work spans the full IP register: trade marks through MyIPO and the Madrid System, copyright and design advisory under Malaysian statute, and contested proceedings before the Registrar and in the High Court. The office is deliberately focused — we do not take on areas outside IP, and we bring that focus to every engagement.

To help rights-holders understand what they hold, document it correctly, and defend it when that becomes necessary.

Written advice at each stage. Realistic timelines. A preference for pre-action resolution in enforcement matters. Full proceedings when they become the right course.

Client Confidentiality

Legal professional privilege applies to all communications. Client files and data are handled under strict confidentiality obligations consistent with Bar Council guidelines.

Written Advice Standard

All substantive advice is delivered in writing, with a clear statement of the basis, the alternatives considered, and the points at which the position may change.

Transparent Fee Structure

Professional fees and official disbursements are set out in advance for each engagement. There are no hidden charges, and no stage proceeds without the client's approval.

Intellectual property in Malaysia is governed by a distinct body of statute — the Trade Marks Act 2019, the Copyright Act 1987, the Industrial Designs Act 1996, and the Patents Act 1983, each with its own procedural and substantive requirements. Cipta Partners works within that framework day to day, which means clients receive advice grounded in current MyIPO practice and Malaysian judicial treatment of IP disputes, not generic regional commentary.

For businesses operating internationally, the Madrid System and bilateral arrangements with key trading partners matter considerably. We take the time to map out which territories are relevant to each client's commercial position before recommending a filing strategy — because the right approach for a Klang Valley manufacturer is not the same as the right approach for a Kuala Lumpur-based technology platform with regional ambitions.

Owner-operators, creative studios, and technology ventures form the core of our client base. These are clients who need to understand their IP position clearly — at formation, at investment, and when a conflict arises. We work to give them that understanding in plain language, without reducing the complexity of the legal position where the complexity actually matters.
