Case · 001

International Trade Mark Registration for a F&B Brand

CHALLENGE

A Kuala Lumpur F&B brand preparing to expand into Singapore, Thailand, and Australia needed trade mark protection across those territories but wanted to manage the process from a single point of contact.

SOLUTION

Cipta Partners filed a Malaysian base application covering the relevant classes, then filed an international application under the Madrid Protocol designating the three target territories. Written status notes were provided as each jurisdiction's examination proceeded.

OUTCOME

Registration obtained in Malaysia, Singapore, and Australia. Thai examination produced an objection that was addressed through a response; registration followed. Total timeline: approximately 22 months across all territories.

Copyright Chain-of-Title for a Technology Platform

CHALLENGE

A Series A funding round for a Kuala Lumpur SaaS platform was delayed when the lead investor's legal counsel identified gaps in the copyright chain for code developed by early freelance contributors over a three-year period.

SOLUTION

Cipta Partners conducted a copyright ownership audit across the platform's codebase, identified the four contributors whose assignments had not been properly documented, and prepared tailored assignment deeds for each.

OUTCOME

All four contributors executed the assignment deeds. The investor's counsel confirmed the IP position was satisfactory. The funding round closed on its revised schedule, approximately three weeks after the audit was completed.

Trade Mark Opposition and Revocation Proceedings

CHALLENGE

A registered mark owner discovered that a third party had obtained a registration in overlapping classes using a confusingly similar mark. The registration was three years old and had not been challenged at opposition stage.

SOLUTION

Cipta Partners provided a written case assessment, advised that revocation proceedings before the Registrar were viable on grounds of non-use, and filed the application. Pre-action correspondence was sent in parallel, which opened settlement discussions.

OUTCOME

The matter settled through a co-existence agreement before the revocation proceedings concluded. The client retained their primary class coverage and the other party restricted their registration to non-competing goods. Total engagement: approximately eight months.
